Terms of Service

Welcome to Cuddler. By accessing or using our mobile application and associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using Cuddler.

1. Acceptance of Terms

By creating an account, downloading the application, or otherwise using the Service, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

These Terms constitute a legally binding agreement between you and Cuddler ("we," "us," or "our"). We reserve the right to update these Terms at any time. When we make material changes, we will notify you through the application or by email. Your continued use of the Service after such notice constitutes acceptance of the revised Terms.

2. Description of Service

Cuddler is a community-based platform that connects pet owners ("Seekers") with local community members who provide pet care support ("Caregivers"). The Service facilitates introductions and coordination between Seekers and Caregivers but does not itself provide pet care services. Cuddler is a technology platform only.

All care arrangements are made directly between Seekers and Caregivers. Cuddler does not employ Caregivers, supervise care activities, or guarantee the quality, safety, or suitability of any care provided through the platform.

3. User Accounts

3.1 Registration

To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your credentials.

3.3 One Account Per Person

You may only create one account per person. Creating multiple accounts may result in the suspension or termination of all your accounts.

4. User Roles

4.1 Seekers

Seekers are users who post pet care requests and connect with Caregivers. As a Seeker, you are responsible for accurately describing your pets, their needs, and any relevant medical or behavioral information. You must ensure the safety of any Caregiver who visits your home or interacts with your pet.

4.2 Caregivers

Caregivers are community members who offer their time and assistance to Seekers. By taking on a caregiving role, you agree to treat all animals in your care with kindness and to follow the instructions provided by Seekers. You must not misrepresent your qualifications or experience.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms

• Post false, misleading, or fraudulent information

• Harass, threaten, intimidate, or harm other users

• Collect or store personal data about other users without their consent

• Use automated tools to scrape, crawl, or otherwise extract data from the Service

• Post content that is defamatory, obscene, pornographic, or otherwise objectionable

• Impersonate any person or entity

• Use the Service to facilitate animal abuse, neglect, or any illegal activity involving animals

• Attempt to gain unauthorized access to any part of the Service or its systems

• Introduce malware, viruses, or other harmful code into the Service

Violations of this section may result in immediate account termination and, where appropriate, referral to law enforcement.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you submit to the Service, including profile information, pet photos, and messages ("User Content"). By submitting User Content, you grant Cuddler a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service.

6.2 Our Intellectual Property

All trademarks, logos, designs, and other intellectual property associated with Cuddler are owned by us or licensed to us. You may not use them without our prior written consent.

6.3 Feedback

If you provide feedback or suggestions about the Service, we may use that feedback without any obligation to you.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

8. Third-Party Services

The Service may contain links to or integrations with third-party websites and services. We are not responsible for the content, practices, or policies of third parties. Your interactions with third-party services are governed by their respective terms and policies.

9. Disclaimers and Limitation of Liability

9.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUDDLER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Cuddler and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may also delete your account at any time by following the instructions in the application. Upon termination, your right to use the Service ceases immediately.

Provisions that by their nature should survive termination will survive, including but not limited to Sections 6, 8, 9, 10, and 12.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Cuddler is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property disputes.

13. Changes to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
